Bethenny Frankel no longer has to pay her ex child support

Bethenny Frankel no longer has to pay Jason Hoppy child support, after her ex-husband agreed to remove himself from the ‘toxic environment’ of their custody battle. 

The decision was made by a family judge at an emotional remote court hearing on Wednesday, PageSix reports.

It was revealed on the video call that partly due to her parents’ nasty divorce battle, Frankel’s daughter Bryn, 11, has been suffering from ‘anxiety, hyperventilation and hives’ and often refuses to see her father.

The former RHONY star’s attorney Allan Mayefsky requested that his client stop paying child support for their daughter as she has chosen to primarily live with her mother.

Hoppy, 51, is said to have attended the hearing without a lawyer and read out a statement where he said he would not be fighting Frankel’s requests on the matter. 

He explained that he was removing himself from the custody fight ‘for Bryn and my physical, emotional and mental health.’ 

‘I will not spend the remainder of Bryn’s childhood fighting as we share joint physical custody,’ he reportedly said in his statement. ‘Bryn knows I love her, I want her and I will always be available for our time together.’

In their ongoing divorce case, which as been dragging on for almost nine years, there was a 50/50 child custody agreement in place that meant Frankel had to make child support payments to Hoppy. 

However, it transpires that Frankel’s daughter Bryn does not always enjoy spending time with her father, and lawyer Mayefsky requested the judge to modify the custody schedule to reflect this. 

Per the report Mayefsky said: ‘We have to put in a schedule that Bryn can be comfortable with that the court can order so we don’t have these constant fights going on.’

Adding: ‘We need to recognize that Ms. Frankel is the primary parent … she should not be paying child support at this point.’

Doing what’s best: A judge has adjusted the custody agreement so that Bethenny is the primary caregiver for Bryn 

Frankel is said to have appeared looking polished in a white blouse for the video call, and make it clear that even with a structure in place, her daughter Bryn won’t always choose to spend time with her father.

‘Whatever you put on paper, that’s great for structure, but she is a living, breathing thing and she won’t always go,’ she reportedly told the judge. 

Speaking to Hoppy about the matter, Manhattan Supreme Court Justice Michael Katz told him that if he did object to Frankel’s motion, then ‘the relief that is sought will be granted.’

Hoppy responded saying: ‘I’m removing myself from this toxic environment. It’s not good for myself or Bryn.’

Frankel finalized her divorce with her ex in January, nearly eight long years after they initially split.

The former couple have waged public wars against each other since their split in December 2012 after just two years of marriage.

They each received joint custody of their daughter in 2014, but Frankel pursued sole custody three years ago.
