Dave Grohl reacts to the Nirvana Nevermind album cover lawsuit and reveals the re-release album cover may be altered: ‘I have many ideas of how we should alter that cover’

More than a month after Spencer Elden – the man who posed on Nirvana’s iconic Nevermind album cover as a baby – sued the group for child pornography, Dave Grohl has finally responded.

The 52-year-old musician, who was the drummer for Nirvana for the album, was named as one of the defendants in the suit, along with the estate of late frontman Kurt Cobain, and Krist Novoselic, along with photographer Kirk Weddle, Universal Music, Geffen Records, Warner Records and MCA Music.

Grohl was speaking with The Sunday Times, when he revealed that they are planning on tweaking the album cover for the upcoming 30th anniversary re-release.

‘I have many ideas of how we should alter that cover but we’ll see what happens. We’ll let you know. I’m sure we’ll come up with something good,’ Grohl said.

The re-release is slated to debut next month, though it’s unclear when the album cover may be shown.

When asked to comment on the lawsuit itself, Grohl said, ‘I think that there’s much more to look forward to and much more to life than getting bogged down in those kinds of things. And, fortunately, I don’t have to do the paperwork.’

The lawsuit was filed in late August, where the 30-year-old Elden demanded that the artwork be changed for any subsequent re-releases.

‘If there is a 30th anniversary re-release, he wants for the entire world not to see his genitals,’ Elden’s attorney Maggie Mabie said.

Elden is asking for $150K from each of the more than a dozen defendants, for, ‘lifelong damages’ from the album cover.

The lawsuit alleges the band, ‘intentionally commercially marketed Spencer’s child pornography and leveraged the shocking nature of his image to promote themselves and their music at his expense.’

‘Cobain chose the image depicting Spencer — like a sex worker — grabbing for a dollar bill that is positioned dangling from a fishhook in front of his nude body with his penis explicitly displayed,’ the lawsuit adds.

Elden had participated in various re-enactments for the album’s anniversaries, though he was always wearing swimming trunks.

He also joked in a 2016 interview that it was, ‘cool but weird to be part of something so important that I don’t even remember.’

He added that he went to an opening day game at Dodger Stadium, ‘and I was looking out at all the people, and I had a moment where I was like “Man, all of these people have seen my baby penis. It’s pretty crazy.”‘

‘It’d be nice to have a quarter for every person that has seen my baby penis,’ Elden added in the interview, adding it would be ‘cool’ to donate that money to suicide prevention causes.
